Resolution No. 2019-22 - Passed By Consensus

Constitutional Amendments

Whereas;  The Vuntut Gwitchin First Nation, having boundless pride in our ancient cultural heritage
		and ancestral homeland, a desire to exercise our inherant right to self-government, to exercise 
		responsibility for the general welfare of our Citizens and to provide for the good government of 
		our communities, lands and resources;

Whereas;  The Vuntut Gwitchin First Nation Constitution ("the Constitution") is the highest law of 
		the Vuntut Gwitchin First Nation ("the First Nation") that embodies fundamental principles 
		of governance and protects the rights and freedoms of the Vuntut Gwitchin First Nation 
		Citizens (the "Citizens");

Whereas;  The Constitution is a living document that, from time to time, must be amended to reflect
		evolving values and the will of the Citizens;

Whereas;  The Constitution should align with the provisions of the Vuntut Gwitchin First Nation 
		Final Agreement and the Vuntut Gwitchin Self-Government Agreement;

Whereas;  A Constitution Review Committee (the "CRC") was struck in 2017 to review the existing 
		version of the Constitution, and to propose any necessary amendments and/or deletions;

Whereas;  In the summer of 2019, the CRC concluded its two-year review of the Constitution, which
		included four community consultation sessions for Citizens in Whitehorse and Old Crow 
		over that period of time;

Whereas;  Proper notice of the proposed Constitutional amendments was given to Citizens according 
		to the procedure stated in the 2006 version of the Constitution;

Whereas;  During the 2019 Vuntut Gwitchin First Nation General Assembly, which included two days 
		dedicated solely to the Constitution review (August 6, August 7, 2019), the CRC presented 
		their proposed Constitutional amendments to the Citizens and provided an opportunity for 
		discussion, debate and approval/rejection of those amendments;

Whereas;  The proposed Constitutional amendments brought to the 2019 Vuntut Gwitchin First Nation 
		General Assembly were discussed, debated and voted on by a quorum of Vuntut Gwitchin 
		Citizens in accordance with the amendment procedure stated in the 2006 version of the 
		Vuntut Gwitchin First Nation Constitution;

Whereas;  Debate, discussion and voting on the Constitutional amendments concluded at
		noon August 8, 2019;

Whereas;  The Constitutional amendments listed below reflect those amendments that were approved 
		by a quorum of Vuntut Gwitchin First Nation Citizens during August 6, 7 and 8 of the 2019 
		Vuntut Gwitchin First Nation General Assembly;

Whereas;  The approved Constitutional amendments, if adopted through this resolution, will be 
		incorporated into the existing Constitution along with any necessary typographical, 
		grammatical and/or formatting edits. 


Therefore Be It Resolved;	

That the Constitutional amendments listed as "passed" or "amended/passed" by the General Assembly, 
attached to this resolution in Appendix 1 be: a) added to the existing Constitution where the numbered 
amendment is catagorized: i. solely through enumeration, e.g. "42"; ii. as "new", using the 
letter N, e.g. "12N"; iii. as "added during the General Assembly" using the letter A, e.g., "20A" 
b) removed from the exisiting Constitution where the amendment is categorized as "remove" using 
the letter "R", e.g., "110R"

That the Constitution amendments listed as "not passed" by the General Assembly, attached to this 
resolution in Appendix 1, be neither removed from or nor added to the exisiting Constitution whether 
the amendment is categorized: i. solely through enumeration, e.g., "42"; ii. as "new", using 
the letter N, e.g., "12N"; or iii. as "added during the General Assembly" using the letter A, e.g., "20A"
